Terms of Service

These terms govern your use of BurnRateIQ (the "Service", "we", "us"). By creating an account or using the Service, you agree to them. If you use the Service for a company, you confirm you can bind that company to these terms.
1. What the Service Does
The Service builds financial models from data you provide or connect: accounting records, billing and payroll data, uploaded statements and your own inputs. It fills gaps with benchmarks and default assumptions and lets you export the model to Excel.
2. Not Financial, Tax or Legal Advice
The Service is a planning tool. Its projections, benchmarks, tax rates and defaults are estimates and can be wrong or out of date. You decide what to rely on. Check important numbers with a qualified accountant, tax advisor or attorney before you use them to raise money, file taxes, set pay or make other decisions.
3. Your Account
- Give accurate sign-up details and keep your password private.
- You are responsible for activity under your account and for the people you invite to your company.
- Tell us at once through Support if you suspect unauthorized access.
4. Your Data
You own the data you bring to the Service and the models it produces. You give us permission to host, process and display that data only to run and improve the Service for you, as described in the Privacy Policy. We do not sell your data.
Connections to accounting, billing and payroll systems are read-only. You confirm you have the right to connect each system and to share employee information, such as salaries, with the Service.
We may use de-identified, aggregated data (never identifying you, your company or your employees) to improve benchmarks and the Service.
5. Acceptable Use
Don't misuse the Service. In particular, don't:
- access another company's data or try to get around permissions;
- upload malware or data you have no right to share;
- probe, overload or reverse-engineer the Service, or scrape it with automated tools;
- use the Service to break the law or mislead investors or lenders.
6. Plans, Payment and Cancellation
- Paid plans renew each month or year until you cancel. Cancellation takes effect at the end of the paid period.
- A one-time model purchase covers one model build and 30 days of on-screen access. If you upgrade to Pro within 30 days, we credit the purchase price toward your Pro invoices.
- Fees exclude taxes. Except where the law requires, payments are non-refundable.
- We may change prices with at least 30 days' notice; changes apply from your next renewal.
7. Third-Party Services
The Service connects to systems you choose, such as QuickBooks, Xero, Stripe and Gusto. Their own terms govern your use of them, and we are not responsible for their availability or accuracy.
8. Availability and Changes
We work to keep the Service available but don't guarantee it will be uninterrupted or error-free. We may change or discontinue features. If we discontinue the Service, we will give you at least 30 days to export your models.
9. Ending Your Account
You can close your account at any time. We may suspend or close accounts that break these terms. After closure we delete your data as described in the Privacy Policy.
10. Disclaimers and Limitation of Liability
The Service is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
11. Indemnity
You will defend and indemnify us against claims arising from data you upload or connect without the right to do so, or from your breach of these terms.
12. Governing Law
Delaware law governs these terms, without regard to conflict-of-law rules. Disputes go to the state or federal courts located in Delaware.
13. Changes to These Terms
We will notify you by email or in the app at least 30 days before material changes take effect. Continuing to use the Service after that means you accept the new terms.
